Our services

Scripta Notarissen (which shall also be understood to include each of the civil-law notaries associated with this company) only requests your personal data for the following purposes:

  • carrying out assignments for advice or other services;
  • to comply with statutory duties and obligations; or
  • for the purposes for which you have given specific consent.

Your data will not be processed for other purposes without your consent. Personal data is requested for the preparation of a notarial deed or for the execution of another assignment.

Rules regarding personal data in notarial deeds

When Scripta Notarissen draws up a notarial deed containing your personal data, it (read here also: the civil-law notary who executes this deed) must comply with legal rules. These affect the processing of personal data. We mention:

  • The notary is legally required to include certain (personal) data in the notarial deed. Your data is therefore processed on a legal basis.
  • The civil-law notary is legally required to always keep the signed notarial deed containing your personal details. Once the notarial deed has been signed by the civil-law notary, it becomes an official piece of evidence. Nothing more may then be changed, not even if the personal details are incorrect. If changes are necessary, the civil-law notary must draw up a new deed stating the change.
  • The notary is required to verify certain personal details in the Dutch Personal Records Database (BRP), the Commercial Register (maintained by the Chamber of Commerce), and (the public registers of) the Land Registry.
  • The notary is legally required to verify your identity. To do this, they must request a valid identity document from you. The notary is one of the few who is also permitted to make a copy of this, including all the information stated on it.
  • Your personal data is covered by the notary's professional secrecy. Unauthorised persons will not be given access to this data.

Advice and other services

For the remaining processing of personal data by Scripta Notarissen, the following applies: the processing of personal data by requesting, collecting, consulting, using and storing it for the purpose of services that are not linked to a notarial deed, such as advisory work, the drafting of one or more private deeds and the settling of an estate, has the following purposes and corresponding legal bases:

  • carrying out an assignment given by one or more clients;
  • performing a contract.

The processing of the aforementioned personal data takes place on the basis of a legitimate interest, namely: it contributes to identifiability and therefore legal certainty regarding the accuracy of, and thus traceability to, the person or persons to whom a legal opinion is provided, private deed(s) are drawn up, or for whose benefit notarial activities (other than a notarial deed) are performed.

Source of processed personal data

If Scripta Notarissen processes personal data about you that it has not obtained from yourself, this will always be done in the context of an assignment entrusted to it. The source of that data may then be one of the following:

  • the public registers, including the Land Registry;
  • an estate agent or other adviser in connection with a (purchase) agreement to which you are one of the parties;
  • an opposing party to a (purchase) agreement in which you are one of the parties;
  • a tax or other adviser in connection with a (purchase) agreement to which you are one of the parties;
  • the statutory director of a legal entity of which you are a mediate or immediate (co-)shareholder or (co-)certificate holder in connection with a (purchase) agreement to which you are a party as a (co-)shareholder or (co-)certificate holder;
  • one of the other heirs or of the executor of an open estate;
  • a judicial decision or order which has become final and binding.

Transferring your personal data

Scripta Notarissen only passes on your personal data to others (third parties) if that is legally required or if it is strictly necessary to carry out the work. Scripta Notarissen provides personal data to the following recipients:

  • the persons named in the draft deed and/or notarial deed;
  • the chain partners engaged by the client (such as estate agents, mortgage advisors and tax advisors);
  • the parties and registers to which the civil-law notary is required by law to send a copy or extract or with which they are required to register it (such as the Royal Dutch Association of Civil-law Notaries for central registration).

Scripta Notarissen does not transfer personal data outside the EU or to an international organisation.

Storage of your personal data

Scripta Notarissen does not retain your personal data longer than necessary for the purpose for which it was collected, for the exercise of statutory tasks and compliance with legal obligations, or for the execution of agreements (such as limitation periods). Retention periods from statutory provisions, such as the Notaried Act and the Archives Act, apply (in part) to this. Notarial deeds are always retained.

Your rights regarding personal data processed by Scripta Notarissen

When your personal data is processed by Scripta Notarissen, you can exercise the rights listed below pursuant to the General Data Protection Regulation (GDPR). You can do this by submitting a request (preferably in writing) using the contact details provided in this privacy statement. Before Scripta Notarissen grants your request, it will first need to identify you on the basis of a valid identity document.

Right of access of the data subject

You can always request which personal data Scripta Notarissen processes, for what purpose that is and how long this data is kept by Scripta Notarissen. There may be a legal basis as a result of which Scripta Notarissen cannot comply with your request. Scripta Notarissen will assess this and inform you accordingly.

Right to rectification

When you believe that certain data has not been processed correctly, you have the right to request the rectification of this data. If this concerns data in a notarial deed, that is not possible and a new (rectification) deed will have to be drawn up as an addition to the incorrect deed.

Right to erasure (right to be forgotten)

If you want your personal data to be deleted, you can submit a request to Scripta Notarissen for this purpose. If the data is contained in a notarial deed, the civil-law notary is not permitted to delete it.

Right to restriction of processing

When you wish to restrict the processing of personal data by Scripta Notarissen (pending rectifications of your personal data requested by you, an objection raised against processing or because you specifically do not want data to be deleted even though the processing is unlawful), you can submit a request for this purpose.

Right to data portability

When your personal data is not being processed for a notarial deed and you wish to transfer the personal data to another service provider, you can submit a request for this to Scripta Notarissen. Incidentally, such a transfer is not always possible, as legal notarial duties may prevent this.

Right to object

If we use your data for direct marketing, you can object to this processing.

Possible limitations in the exercise of your rights under the GDPR

Scripta Notarissen makes every effort to comply with your rights under the General Data Protection Regulation (GDPR). However, it may occur that these rights conflict with other statutory provisions, such as the Notaried Profession Act (Wet op het notarisambt). Should the notary be unable to comply with one of the aforementioned requests for that reason, you will be notified of this in writing.

Complaints regarding the processing of your personal data by Scripta Notarissen

If you have any complaints about the processing of personal data by Scripta Notarissen Notary Practice, they would be pleased to hear about this via smit@scriptanotarissen.nl. You also have the right to lodge a complaint with the supervisory authority, the Dutch Data Protection Authority (Autoriteit Persoonsgegevens). Links to third-party websites

The Scripta Notarissen website and social media may contain links to third-party websites. Scripta Notarissen accepts no responsibility for the manner in which these websites handle your personal data. We advise you always to read the privacy statement of the website you are visiting.

Cookie Policy

A method used on many web pages to make web pages function better and to better tailor them to user preferences is the use of so-called (temporary or permanent) "cookies". These are small text files that are automatically placed on a visitor's computer by the web page being visited. These can, for example, record a visitor's preferences so that the web page can be automatically adjusted to these preferences during a subsequent visit. The Scripta Notarissen website uses cookies for the following three purposes:

Functional purposes
to enable logging in to and navigating the website. A cookie is also used when you use the feature to share a page via social media. These are temporary cookies that expire at the end of the browser session. The information recorded in this cookie is not provided to third parties; it is only stored in the visitor's browser for a period of 180 days. This is a standard period.

2. Personalisation/optimisation purposes
to be able to show you relevant pages based on your browsing behaviour. Your browsing behaviour on this website may be used to show you relevant information about our products and services on third-party websites. Scripta Notarissen also uses cookies to A/B test various pages, allowing Scripta Notarissen to optimise its website as much as possible. When visiting the Scripta Notarissen website, this cookie is placed on the visitor's browser and is assigned a unique number. This number can be recognised so that Scripta Notarissen can display suitable information on the website the user is currently on (this can be anywhere on the internet). The information recorded in the cookie is not provided to third parties; it is only stored in the visitor's browser for a period of 180 days. This is a standard period.

3. Analytical purposes
to measure and analyse the use of the Scripta Notarissen website. Example: it is possible to track how many visitors a specific page receives. This information is always anonymous, meaning that who visits what cannot be traced back. For this purpose, the Scripta Notarissen website uses Google Analytics, a web analysis service provided by Google Inc. ("Google"). Google Analytics uses "cookies". The information generated by these cookies about your use of the Scripta Notarissen website (including your IP address) is transmitted to and stored by Google on servers in the United States of America. Google uses this information to track how you use the Scripta Notarissen website, to report on website activity for Scripta Notarissen and to provide other services relating to website activity and internet usage. Google may provide this information to third parties if required to do so by law, or insofar as these third parties process the information on Google's behalf. Google will not associate your IP address with any other data held by Google. This information is therefore only stored in the visitor's browser for a period of 180 days. This is a standard period.

You can set your browser to notify you when a cookie is placed or to prevent the collection of cookies. You can also regularly delete the cookies stored on your computer. However, you will then no longer be able to make full use of all the features of the Scripta Notarissen website.

Social media

To show you targeted posts or advertisements, Scripta Notarissen may make use of the opportunities offered by social media platforms to advertise through them, such as Facebook. For this purpose, Scripta Notarissen may provide your email address or telephone number to the relevant platform in a hashed (encrypted, non-traceable) manner. Due to the hashing, the social media service provider cannot retrieve your email address or telephone number, but can ensure that advertisements are tailored to your profile if you are a member of the relevant platform, for example by showing you information about Scripta Notarissen. Consequently, the platform does not possess data that can be directly traced back to your personal data, other than the data you have already provided to the provider of the relevant platform yourself or that is already known to the platform. Through this targeted approach, Scripta Notarissen ensures that you are shown as much relevant information as possible.

If you object to this procedure, please let us know by email at smit@scriptanotarissen.nl stating "Opt out of targeted info via FB platform". Furthermore, you can opt out of advertisements with the platform in question; in the case of Facebook via the privacy settings. More information about the processing of data by Facebook, with setting and opt-out options to protect your privacy, can be found in Facebook's privacy policy, including at https://www.facebook.com/ads/website_custom_audiences/

Changes

Scripta Notarissen may amend this privacy policy. We advise you to check regularly for any amendments. You can find the date of the last amendment at the bottom of this document.
